Terms & Conditions

By downloading or using the “NYSORA” app, these terms will automatically apply to you. Therefore, you should make sure that you read them carefully before using the app. You are not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You are not allowed to attempt to extract the source code of the app. You are not allowed to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights and other intellectual property rights related to it, all belong to NYSORA.

NYSORA is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it very clear to you exactly what you are paying for.

A 9,95$ monthly purchase will be applied to your iTunes account. Subscriptions will automatically be renewed unless canceled within 24-hours before the end of the current period. You can cancel anytime with your iTunes account settings. For more information, see our Privacy Policy.

The “NYSORA” app stores and processes personal data that you have provided to us, in order to provide our service. It is your responsibility to keep your phone and access to the app secure. We, therefore, recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that the “NYSORA” app will not work properly, or at all.

The “NYSORA” app may require transmission of information provided by you including usernames/passwords, your name, address, e-mail addresses and financial information, in order to register and operate your “NYSORA” app account. You consent to the transmission of your Information to NYSORA and its agents, to process your Information as may be necessary for the “NYSORA” app to perform its functions. You acknowledge that your Information will be stored by the “NYSORA” app in your device in an encrypted format. NYSORA may use such information to analyze and understand our audience, improve our service (including our user interface experiences) and communicate with you concerning our service so that we can send you news about NYSORA, details about new features and content available on NYSORA, special offers, marketing promotions, promotional announcements, consumer surveys, and to assist you with operational requests such as password reset requests. These communications may be by various methods, such as email, push notifications, text message and online messaging channels.

You should be aware that there are certain things that NYSORA will not take responsibility for. Certain functions of the app will require the app to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but NYSORA cannot take responsibility for the app not working at full functionality if you do not have internet access.

If you are using the app outside of an area with Wi-Fi, you should remember that your terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. By using the app, you are accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

With respect to NYSORA’s responsibility for your use of the app, when you’re using the app, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. NYSORA accepts no liability for any loss, direct or indirect, that you experience as a result of relying wholly on this functionality of the app.

At some point, we may wish to update the app. The app is currently available on Android & iOS – the requirements for both systems (and for any additional systems we decide to extend the availability of the app to) may change, and you will need to download the updates if you want to keep using the app. NYSORA does not promise that it will always update the app so that it is relevant to you and/or works with the Android & iOS version that you have installed on your device. However, you promise to always accept updates to the application when offered to you.

We may also wish to stop providing the app and may terminate the use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.

Can I update, correct or delete my information?

Users have the right to request the restriction and deletion of certain uses and disclosures of personally identifiable information as follows. You can contact us in order to (1) update or correct your personally identifiable information, (2) change your preferences with respect to communications and other information you receive from us, or (3) delete the personally identifiable information maintained about you on our systems (subject to the following paragraph), by canceling your account.

Users also can also delete their own account within our applications by going to the user dashboard and clicking on Delete account button.

Such updates, corrections, changes and deletions will have no effect on other information that we maintain or information that we have provided to third parties in accordance with this Privacy Policy prior to such update, correction, change or deletion. To protect your privacy and security, we may take reasonable steps (such as requesting a unique password) to verify your identity before granting you profile access or making corrections. You are responsible for maintaining the secrecy of your unique password and account information at all times.

You should be aware that it is not technologically possible to remove each and every record of the information you have provided to us from our system. The need to back up our systems to protect information from inadvertent loss means that a copy of your information may exist in a non-erasable form that will be difficult or impossible for us to locate. Promptly after receiving your request, all personal information stored in databases we actively use, and other readily searchable media will be updated, corrected, changed or deleted, as appropriate, as soon as and to the extent reasonably and technically practicable.

Subscriptions

The “NYSORA” app is a subscription service, meaning you pay to access content from “NYSORA” for a certain period of time. Subscriptions will automatically renew until you manually cancel them. Your payment method will be charged at the beginning of each subscription period.

To cancel a subscription, please do so through your Android or iOS platform:

ALL PURCHASES, INCLUDING RECURRING CHARGES, ARE FINAL AND NON-REFUNDABLE.

Changes to This Terms and Conditions

We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.
